Terms & Conditions of Purchase and Usage

1. Acceptance of Terms

By purchasing any product, service, class, membership, or package from Kind Society, you agree to be bound by these Purchase Terms and Conditions. Please read them carefully before making any purchase.

2. Payment Terms

Accepted Payment Methods: We accept credit cards, debit cards, and other payment methods as displayed at checkout via online payment. In person payment methods are limited and may not be possible.

Payment Processing: All payments are processed securely through our payment processor. By providing payment information, you authorize us to charge the applicable fees to your payment method.

Pricing: All prices are displayed in CAD unless otherwise stated. We reserve the right to modify pricing at any time, though changes will not affect purchases already completed.

Automatic Billing: For memberships and recurring subscriptions, you authorize us to automatically charge your payment method on the renewal date until you cancel.

3. Refund & Cancellation Policy

As a small, non-profit organization, all revenue directly supports fair teacher compensation, operating costs, and the continued offering of accessible, community-based programming. As a result of this, all purchases made with Kind Society are non-refundable. This includes, but is not limited to:

  • Single classes and drop-in classes

  • Class passes (including multi-class passes)

  • Membership payments

  • Workshops, series, and special events

  • Retail purchases, including physical and digital products

Class Packages & Credits: All class package sales are final. Unused credits do not expire unless otherwise stated at the time of purchase.

Single Classes: Cancellations must be made at least 24 hours before the scheduled class time to receive an account credit (refunds are not issued). Account credits are not automatically issued; please contact us if you would like a credit applied to your account. Late cancellations or no-shows are non-refundable and are not eligible for account credit.

Memberships: Monthly memberships may be canceled at any time, but you will retain access through the end of your current billing period. No partial refunds will be issued for unused time.

Digital Store Products: Due to the nature of digital goods, all sales of digital products, courses, and downloadable content are final and non-refundable.

Physical Store Products: Due to the bespoke nature of most of our physical products, all sales of physical products are final and non-refundable.

No-shows & missed classes: Missed classes and no-shows are not eligible for refunds or credits. A no-show fee may be incurred by membership holders and charged automatically to their account.

Processing fees: Any approved refunds or credits will have all original third-party processing, card processing, and service fees deducted from the refund amount.

Account credits may be issued on a case-by-case basis at the sole discretion of Kind Society. Credits are not guaranteed, have no cash value, and are non-transferable unless explicitly approved. Where applicable, class passes or registrations may be transferred or gifted to another individual with prior approval.

By completing a purchase, you acknowledge and agree to this policy.

4. Class & Event Registration

Reservations: Class and event reservations are subject to availability. We reserve the right to cancel or reschedule classes due to low enrollment, instructor availability, or unforeseen circumstances.

Class Changes: If we cancel a class, you will receive a full account credit or an alternative class option. Refunds may be issued at our discretion where required by law.

Waitlists: If a class is full, you may join a waitlist. If a spot becomes available, you will be notified and charged automatically if you've provided payment information.

Age & Health Requirements: You are responsible for ensuring you meet any age, health, or skill requirements for classes you register for.

5. User Responsibilities

Account Security: You are responsible for maintaining the confidentiality of your account credentials and all activities under your account.

Accurate Information: You agree to provide accurate, current information when making purchases and to update it as necessary.

Prohibited Conduct: You may not resell, transfer, or share access to purchased products, services, or memberships unless explicitly permitted.

Health & Safety: You are responsible for ensuring you are physically capable of participating in any classes or activities. Consult your healthcare provider if you have any concerns.

Account Records & Verification: While class passes do not expire, redemption of any pass or credit is subject to verification within our current registration and record-keeping systems. Clients are responsible for retaining confirmation emails or proof of purchase. Kind Society Yoga cannot guarantee redemption of passes or credits that cannot be reasonably verified due to system changes, data loss, or the passage of time.

6. Limitation of Liability

Kind Society and its instructors, staff, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of our services, products, or facilities.

You participate in all classes, events, and activities at your own risk. We strongly recommend consulting with a healthcare provider before beginning any new fitness or wellness program.

7. Intellectual Property

All content, materials, logos, and designs on our website and in our classes are the property of Kind Society and are protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.

8. Modifications to Terms

We reserve the right to modify these Purchase Terms and Conditions at any time. Changes will be effective immediately upon posting to this page. Your continued use of our services after changes are posted constitutes your acceptance of the modified terms.

We encourage you to review these terms periodically to stay informed of any updates.

9. Dispute Resolution

Governing Law: These terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Kind Society operates.

Disputes: Any disputes arising from these terms or your purchases will be resolved through good faith negotiation. If negotiation fails, disputes may be submitted to binding arbitration or the appropriate courts.
